Acceptable Use Policy

This Acceptable Use Policy (“AUP”) governs your use of CrossMerg’s websites, platforms, hosting services, applications, and related services (collectively, the “Services”). This AUP is designed to protect the security, reliability, performance, and legal compliance of the Services for all users. By accessing or using the Services, you agree to comply with this AUP.

1. Purpose and Scope

This Acceptable Use Policy defines acceptable and prohibited uses of the Services. It applies to all users, customers, account holders, administrators, end users, and any third parties accessing the Services on your behalf (“you” or “User”). This AUP supplements and is incorporated into CrossMerg’s Terms of Service, Hosting Terms, Privacy Policy, and any other applicable agreements or policies.

2. Lawful Use Requirement

You may use the Services only for lawful purposes and in compliance with all applicable local, state, federal, and international laws, regulations, and industry standards. You are solely responsible for ensuring that your use of the Services complies with all laws applicable to your jurisdiction, your content, and your activities.

3. Prohibited Content

You may not use the Services to store, transmit, distribute, or make available any content that is illegal, harmful, or otherwise objectionable. Prohibited content includes, but is not limited to: content that is unlawful, fraudulent, deceptive, or misleading; content that infringes intellectual property rights, privacy rights, or other proprietary rights of others; content that is defamatory, abusive, threatening, harassing, or discriminatory; content involving child exploitation or abuse; obscene, pornographic, or sexually explicit material; content promoting violence, terrorism, or hate; and content that violates any applicable regulation or court order.

4. Prohibited Activities

You may not engage in activities that interfere with, disrupt, or negatively impact the Services, our infrastructure, or other users. Prohibited activities include, without limitation: unauthorized access to systems or data; attempts to bypass authentication or security controls; scanning, probing, or testing system vulnerabilities without authorization; distribution of malware, ransomware, spyware, or other malicious code; launching denial-of-service or similar attacks; sending spam or unsolicited bulk communications; operating open relays or proxy services; mining cryptocurrency without express authorization; and using the Services for fraudulent schemes or deceptive practices.

5. Security and Abuse

You are responsible for maintaining the security of your account credentials and systems. You must promptly apply security updates, use reasonable safeguards, and prevent unauthorized access. Any activity that compromises system security, network integrity, or service availability is strictly prohibited. You must immediately notify CrossMerg if you become aware of any security incident, breach, or misuse involving your account or the Services.

6. Resource Usage and Fair Use

You may not use the Services in a manner that unreasonably consumes system resources or degrades performance for others. This includes excessive bandwidth usage, CPU abuse, disk I/O saturation, or storage misuse beyond the limits of your plan. CrossMerg reserves the right to impose limits, throttle usage, or require service upgrades if your usage adversely affects system stability or other customers.

7. Third-Party Services and End Users

If you provide access to the Services to end users, customers, employees, or third parties, you are responsible for their compliance with this AUP. You may not resell, sublicense, or allow use of the Services in a manner that violates this Policy or any applicable agreement. You remain fully responsible for all activity conducted through your account.

8. Monitoring and Investigation

To the extent permitted by law, CrossMerg may monitor, review, or investigate use of the Services to ensure compliance with this AUP, respond to security threats, or comply with legal obligations. CrossMerg is not obligated to monitor content or activity but reserves the right to do so at its discretion.

9. Enforcement and Remedies

Violations of this AUP may result in corrective actions, including warnings, content removal, service limitation, suspension, or termination of Services, without prior notice. CrossMerg may also report unlawful activity to appropriate authorities. Enforcement decisions are made at CrossMerg’s sole discretion and may be taken immediately to protect the Services or comply with legal requirements.

10. Reporting Violations

If you become aware of a violation of this Acceptable Use Policy, you must promptly report it to CrossMerg. Reports may be submitted through your customer portal or by contacting compliance@crossmerg.com. Reports should include sufficient detail to allow investigation, including relevant logs, timestamps, and affected resources.

11. Changes to This Policy

CrossMerg may update this Acceptable Use Policy from time to time. Changes are effective upon posting unless otherwise stated. Continued use of the Services after an update constitutes acceptance of the revised Policy. You are responsible for reviewing this Policy periodically.
